An individual charged with the possession of drug paraphernalia faces an important decision when they make the choice to retain or hire the services of an attorney to defend them. A paraphernalia drug offenses can carry the possibility of many hard sanctions:

  • Up to thirty days in jail.

  • A fine of up to $250.00.

  • The inability to drive for six months.

  • The mere possession of a pipe with residue will often lead to a second charge of minor misdemeanor possession.

  • Until September 30, 2011, you could not possess a firearm (you couldn't hunt or become a police officer) with a misdemeanor drug conviction.  After September 30, 2011 you cannot possess a firearm if you were charged with a felony drug conviction.  Paraphernalia is a fourth degree misdemeanor.

  • Under certain conditions a conviction will destroy your ability to obtain student loans.

I believe that it is very important that you know exactly what it is you face.  I am available to you 24-hours a day. Unless in court or another place that prohibits phone usage, I am available to you in an emergency, such as when a search warrant being served on your home. One of the first things I will investigate is whether there was probable cause to be where the police were.  The deck is stacked against you here as there are very police-friendly rules such as the "plain smell doctrine", "inventory after arrest", "towing inventory" and other ways around your right to privacy.
