Drugs and Student Loans in Ohio

Laws sometimes weave and bob through time. So it is with the law that limits a student's ability to get educational assistance. The original law was written in 1965. In 1989 the section about drugs was added. The 1989 amendment (Public Law 105-244) states that if a student who is getting aid is convicted of either possession or trafficking in drugs under state or federal law, then the student can't get aid. The question 23 worksheet on the FAFSA form deals with these problems. Definitions of "controlled substance" is in 21 USC 802(6).
Possession
For the first offense, the student must wait one year after his or her date of conviction. For the second offense, two years. After the third offense the student is disqualified.
Trafficking
For the first offense, the student is disqualified for two years after the date of conviction. For the second or further offense, the student is disqualified.
Drug Treatment
There is a provision whereby if the student completes an approved drug treatment program, the student may resume eligibility.
